Uncontested Divorce Law

A divorce often holds the potential to be an incredibly long and painful process for both spouses, but an uncontested divorce may allow both parties to finalize a divorce in a matter of weeks instead of months or even years. There are certain catches before the parties involved can seek an uncontested divorce, however.


For example, Virginia Code § 20-97 establishes that at least one of the spouses has to meet the state residency requirement requiring at least one spouse to have lived in the state for a minimum of six months before filing for divorce. The divorce will also have to be no-fault, meaning that neither party was technically responsible for the end of the marriage.

A couple seeking an uncontested divorce will have to make sure all issues relating to the divorce have been agreed to before filing. These issues will include:

  • Alimony / Spousal support
  • Child support
  • Child custody 
  • Division of real estate and personal property
  • Division of assets and debts


Additionally, each spouse will need to be willing to sign the final divorce papers. The spouses must have been separated for at least six months if they have no minor children or a minimum of one year when there are minor children.
